Work on weekends and non-working holidays

By general rule work on weekends and non-working holidays is prohibited (Article 113 of the Labor Code of the Russian Federation). However, there are exceptions to this rule.

So, you can involve an employee in work on a weekend / non-working holiday, if there is a need to perform unforeseen work, on the urgent implementation of which the further normal functioning of the organization depends. In this case, the employee can be attracted only with his written consent.

By the way, there are situations when hiring an employee on weekends / non-working holidays is possible without obtaining consent from him. For example, such situations include the involvement of an employee to prevent a disaster / industrial accident or eliminate the consequences of a catastrophe / industrial accident / natural disaster (Article 113 of the Labor Code of the Russian Federation).

How is work paid on weekends and non-working holidays

Work on weekends, as well as non-working holidays, must be paid in at least double the amount (Article 153 of the Labor Code of the Russian Federation).

The specific amount of remuneration for work on weekends / non-working holidays can be prescribed in the collective agreement, LNA, labor contract.

Replacing double payment for holidays

An employee who worked on a weekend / non-working holiday may be given another day of rest. In this case, work on a weekend / non-working holiday is paid in a single amount, and the day of rest chosen by the employee is not paid (Article 153 of the Labor Code of the Russian Federation). Note that the initiative to replace double pay for another day of rest should come from the employee, not from the employer.

Usually, according to the rules of the Russian production calendar, a holiday that coincides with a weekend (Saturday or Sunday) is postponed to the next weekday after the weekend. But such a rule may not be convenient in every year, and then the State Duma approves special schedules. This is what happened with the 2018 working calendar.

The day off on January 6 (included in the New Year's holidays) fell on Saturday and was postponed to March 9 in order to "combine" with the weekend on March 8, which falls on Thursday this year.

There are only eight official public holidays, which are non-working days in Russia: these are New Year and Christmas, March 8, February 23, May 1, May 9, June 12 and November 4.
